******* SURINDER GUPTA, J.(Oral) The present petition has been filed under Section 439 Code of Criminal Procedure for grant of regular bail to the petitioner in case FIR No. 75 dated 13.08.2016 registered for the offence punishable under Section 22 of Narcotic Drugs and Psychotropic Substances Act, 1985 at Police Station Subhanpur, District Kapurthala.

Heard.

Notice of motion.

On asking of the court, Mr. C.L.Pawar, Sr. D.A.G., Punjab, who is present in the Court accepts notice and submits that intimation by Registry informing of fixation of the petition has already been received and record of the case is available with him.

Learned State counsel submits that the petitioner was earlier allowed interim bail by the trial Court which was cancelled after the receipt of Chemical Examination Report. In view of submission of learned State counsel, learned counsel for the petitioner seeks permission to withdraw the present petition with liberty to file the application seeking regular bail before the trial Court. In the event of application for regular bail being filed, the same will be decided by the trial Court in accordance with law within a period of 15 days after filing of the application.
