Learned counsel states that regarding the reimburse of the amount of Rs.2,85,019/- pertaining to medical reimbursement claims by the petitioner, the respondents in written statement had stated that the case was forwarded to the Insurance Company on 02.02.2021. 2.
He further submits that as per the scheme PGEPHIS, Rs.3 lacs of amount has to be paid by the Insurance Company, whereafter there is a buffer of Rs.25 crores and after exhausting of the same, the amount has to be paid by the department concerned as per the State Services Medical Attendance Rules, 1940.

He thus, on instructions from the petitioner, submits that a time bound direction be given to respondent No.5-Insurance Company to take a decision, keeping in view the aforesaid, to which learned counsel for respondent No.5 has no objection.

In view of the above and without commenting upon the merits of the case, this petition is hereby disposed of with a direction to respondent HAMANT 2025.01.16 09:29 I attest to the accuracy and integrity of this document
CWP-13270-2019 No5-Insurance Company to consider and decide the claim of the petitioner, keeping in view the aforesaid submissions, within a period of 4 months, which this Court has no reason to believe the authorities would not address in a just, fair and reasonable manner. Upon doing so, after notice and hearing offered to her and if found entitled, grant the benefit forthwith. Needless to say, if the orders are adverse to her interest, the same shall contain reasons and petitioner shall be free to seek legal redress thereupon.
