(Oral) This is a petition filed under Section 438 of the Code of Criminal Procedure seeking pre-arrest bail in a case registered against the petitioner vide FIR No.91 dated 20.10.2017 under Sections 452, 323, 341, 506, 148, 149 and 307 IPC (Section 307 IPC added later on) at Police Station Bakshiwala, District Patiala.

Learned counsel for the State submits that pursuant to order dated December 12, 2017, petitioner has joined investigation and is no longer required for custodial interrogation.

In view of the above, order dated December 12, 2017, is hereby made absolute subject to the conditions envisaged under Section 438(2) Cr.P.C.

Disposed of. In case, petitioner does not co-operate, State/complainant shall be at liberty to seek remedy under Section 439(2) Cr.P.C.
