***** SANJEEV PRAKASH SHARMA, J (ORAL) Prayer in the present petition filed under Section 439 Cr.P.C. is for grant of regular bail to the petitioner in FIR No.62 dated 18.06.2022 under Sections 376(3) 376 (2) (n) and 506 IPC and Section 6 of POCSO Act, registered at Police Station West Sector-11, Chandigarh. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case and he is in custody since 18.06.2022 on the basis of a report submitted by the minor girl of aged about 13 years who stated that she has been went to suffer aggravated sexual assault for almost two years by the petitioner.

Learned counsel for the petitioner further submits that the trial is going on and it will take long time. Learned State counsel, on the other hand, has opposed the present petition for grant of regular bail and submits that the allegations against the petitioner are serious.

Taking into consideration the overall circumstances of the case, and keeping in view the statement of the prosecutrix which has already been recorded in the Court and the trial is pending, this Court is not inclined to grant bail to the petitioner.

Accordingly, the petition is dismissed. However, learned trial Court is directed to conclude the trial at the earliest in terms of the POCSO Act.
