CRM-23308-2020 For the reasons stated in the application, the same is allowed and the hearing of the case is pre-poned to today. CRM-M-23406-2020 This is the first petition filed under Section 439 Cr.P.C. for grant of regular bail to the petitioner in case FIR No.260 dated 5.11.2019 under Sections 302 and 307 IPC, registered at Police Station Badhra, District Charkhi Dadri, Haryana.

Counsel for the petitioner submits that as per the allegations in the FIR, the petitioner, by using a pickup van as a weapon, committed the murder of Mahender Singh. CRM-M-23406-2020 (O&M) -2case of accident which has been given a colour of murder and, therefore, it is a matter of trial and the petitioner is entitled for bail. He further submits that he is the only bread-earner in his family and has been falsely implicated in the case. In reply, learned State counsel has submitted that in fact, the petitioner had a verbal spat with the deceased and in the grip of rage, he with the help of his vehicle ran over deceased Mahender Singh. Learned State counsel has further submitted that eye-witness Vijay, in his statement under Section 161 Cr.P.C., has specifically named the petitioner that he deliberately hit Mahender Singh with his vehicle as a dispute/altercation had taken place between them prior to the incident. It is further stated that the statement of the complainant/eye witness is yet to be recorded. After hearing counsel for the parties and looking into the gravity of offence, I find no ground to grant the regular bail to the petitioner.

Accordingly, the petition stands dismissed.
