The limited prayer made by the learned counsel for the petitioner in the present petition under Articles 226/227 of the Constitution of India is for issuance of a direction to the respondents to consider the claim of the petitioner for promotion by according the benefit of completion of the refresher/orientation course in terms of the judgment dated 17.01.2019 passed by this Court in CWP No.6739 of 2014 [Ashok Kumar & Ors. vs State of Punjab &Ors.].

Learned counsel for the petitioner contends that in this regard a representation dated 05.04.2021 (Annexure P-25) was sent to the respondents. However no decision has been taken qua the same. He further contends that at this stage he would be satisfied if a direction is issued to respondent No.3 to consider the representation dated 05.04.2021 (Annexure P-25) in a time bound manner in the light of the judgment dated 17.01.2019 passed by this Court in CWP No.6739 of 2014 [Ashok Kumar & Ors. vs State of Punjab & Ors.].

On the asking of the Court, Ms. Maloo Chahal, DAG Punjab, accepts notice on behalf of respondent Nos.1 to 3. Since the matter is not being decided on merits, the service of notice upon respondent No.4 is dispensed with, at this stage.

Without commenting on the merits of the case, the present writ petition is disposed off with a direction to respondent No.3 - Director Public Instructions (Colleges), Punjab - to consider the representation dated 05.04.2021 (Annexure P-25) in accordance with law and in the light of the judgment dated 17.01.2019 passed by this Court in CWP No.6739 of 2014 [Ashok Kumar & Ors. vs State of Punjab & Ors.], expeditiously and in any case within a period of two months from the date of receipt of certified copy of this order. Disposed off.
