This is a petition has been filed under Section 482 of BNSS (Section 438 of Cr.P.C) for grant of anticipatory bail to the petitioner in case FIR No. 0038 dated 25.03.2026 under Sections 21, 29 of NDPS, 1985 registered at Police Station Talwandi Bhai District Ferozepur. 2.

The case of the prosecution is that one Prabhjot Singh @ Jota was found in possession of 5.75 grams of heroin and during the course of investigation, he suffered a disclosure statement to the effect that the contraband recovered from him had been supplied by the present petitioner. 3.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and that his name has been surfaced solely on the basis of the disclosure statement made by the co-accused, which is not admissible in evidence. He further submits that no recovery has been effected from the petitioner and that, apart from the said disclosure statement, there is no other evidence to connect him with the alleged offence. Mr. P.S.Pandher, Asst. A.G.Punjab accepts notice on behalf of the respondent-State. He has vehemently opposed the prayer made by the learned counsel for the petitioner on the ground that the allegations against the petitioner are serious in nature. He further submits that the petitioner is involved in three other cases under the NDPS Act and has also been convicted in one of those cases.

I have heard the submissions made by the parties and gone through the record.

Keeping in view the facts and circumstances of the case, the nature and gravity of the allegations against the petitioner, and the fact that he is involved in three other cases under the NDPS Act, which reflects his criminal antecedents and habitual conduct, this Court is of the view that no exceptional or extra ordinary circumstances are made out to extend the concession of anticipatory bail to the petitioners. Consequently, the present petition is hereby dismissed.
