 Present : Mr. Satish Goel, Advocate for the petitioner. Ms. Dimple Jain, AAG, Haryana.

     The petitioner is seeking anticipatory bail in FIR No.1547 dated 17.12.2015 registered under Sections 323, 379A, 506 & 34 IPC and Sections 12, 14 & 15 of POCSO Act, 2012 at Police Station City Gurgaon.

A complaint was lodged by the complainant wherein allegations were made that the petitioner had taken her nude pictures and was blackmailing her and threatening to leak the photographs. The counsel for the petitioner contends that the FIR is a counter5blast to the complaint given by the father of the petitioner. He states that the father of the petitioner is a Lawyer, who was present when the petitioner was beaten up. The counsel refers to MLR at Page 19. The counsel urges that the petitioner's father had made a complaint to the Commissioner of Police.      call was made by the girl and the petitioner was called to a park and he was manhandled and beaten up and left with a bleeding nose. Counsel for the petitioner states that anticipatory bail has been allowed to one of the accused. The counsel has placed on record the order passed in the case of Smt. Suresh Sapra @ Shammi mother of the petitioner.

The State counsel informs that the allegations against the petitioner are serious and the petitioner had taken nude pictures of the girl and he has admitted to that fact in the  chat with the girl and they have the print out of chat today. She urges that the petitioner is blackmailing the girl. The State counsel submits that custodial interrogation is necessary and the allegations are serious and recovery is to be effected.

The  chat available with the State counsel was handed over for perusal. In one of the chats there is admission with respect to the pictures. The girl is also asking for deletion of the pictures.

Accusations have been made that the petitioner is blackmailing the girl, and it is a serious matter. No case for anticipatory bail is made out. Custodial interrogation of the petitioner would be necessary. The petition is dismissed.
