Allegations levelled by complainant Harbans Kaur are that out of the sale consideration of Rs.13 lacs received on account of sale of three bighas 11 biswas agriculture land owned by complainant only Rs.4 lakhs were given to the complainant by her accused son Jagdev Singh and accused daughter-in-law Paramjit Kaur i.e. the present petitioner.

It is contended that the remaining payment of the sale consideration was kept in a joint account of the complainant alongwith present petitioner and the withdrawal,if any, by the petitioner from the said account would not constitute an offence. It is further contended that the Fixed Deposit in the joint account is still active with the bank and the petitioner has joined investigation and fully cooperated. RAJINDER PRASHAD JOSHI 2016.05.

CRM-M 5927/2016 Learned State counsel on instructions does not dispute the availability of the joint Fixed Deposit and that petitioner has joined investigation and that her custodial interrogation is no longer required. In view of the above interim bail granted vide order dated 18.2.2016 is made absolute.
