The present petition has been filed by the petitioners under Articles 226/227 of the Constitution of India, seeking issuance of a writ of mandamus, directing the respondents to include/consider the dependent members of the Armed Forces Personnels who laid down their lives in operation 'Pawan' Sri Lanka under the Indian Peace Keeping Force for appointment in various departments of State of Punjab or in PSU on account of honour and gratitude in view of the Government Instructions dated 19.08.1999 (Annexure P-1) as well as 24.09.1999 (Annexure P-2).

Learned Senior counsel for the petitioners submits that the case of the petitioners is squarely covered by the ratio laid down by a Coordinate Bench of this Court in CWP-15460-2016 titled as 'Sarabjeet Singh Sidhu (Through His Legal Representatives) Vs. State of Punjab and others' decided on 20.12.2023. He further submits that though, against the said judgment, LPA No.1263-2024 titled as 'State of Punjab and others Vs. Sarabjeet Singh Sidhu Through LRs and another' is pending, however, there is no stay in the said LPA and the same is now pending for 04.05.2026. He also submits that for redressal of their grievances, the petitioners have also served legal notice dated 23.12.2025 (Annexure P-5) to the respondents which is still VINOD KOTHIYAL 2026.04.18 13:57 I attest to the accuracy and authenticity of this document

CWP-11487-2026 -2pending consideration. He further submits that at this stage, the petitioners would be satisfied, if appropriate directions are issued to the respondents to consider and decide the said legal notice, by passing a speaking order, in a time bound manner.

Mr. Satnampreet Singh Chauhan, D.A.G., Punjab, accepts notice on behalf of the respondents-State. He has no objection to the innocuous prayer made by learned counsel for the petitioner. 5.

I have heard learned counsel for the parties and have gone through the record of the case.

Without going into the merits of the case at this stage, the present petition is disposed of with a direction to respondent No.2 to consider and decide legal notice dated 23.12.2025 (Annexure P-5) submitted by the petitioners expeditiously, in light of the judgment passed by this Court in Sarabjeet Singh Sidhu's case (supra), by passing a speaking order after affording an opportunity of hearing to the petitioners, preferably within a period of 03 months from the date of receipt of certified copy of this order. Further, the decision taken thereon shall be conveyed to the petitioners.
