Present appeal has been filed by the plaintiff (appellant herein) against the concurrent finding of dismissal by the Courts below. 2.

Appeal was filed in the year 2019, and thereafter, none appeared on 17.07.2023. However, on written request, hearing was deferred to 24.07.2023. 3.

Again on 24.07.2023, no one appeared on behalf of the appellant, however, in the interest of justice, while granting last opportunity, case was adjourned to 08.08.2023. Besides, Registry was also directed to inform the counsel for the appellant about the next date of hearing. 4.

On 08.08.2023, Mr. Ram Darshan Yadav, Advocate, appeared on behalf of the appellant and informed the Court that the appellant has taken away the brief from him in January, 2023, thus, he expressed his helplessness in assisting the Court. Accordingly, in the interest of justice, hearing of the case was deferred for 23.08.2023 i.e. today itself.

Even today also, it is informed to the Court by the appearing counsel that in the absence of any brief with the engaged counsel i.e. Mr. Ram Darshan Yadav, he is unable to make submissions before this Court. 6.

In view of above, it appears that appellant is not interested in pursuing the appeal.

Dismissed for non-prosecution.
