 !"#  $ The allegations against the petitioner accused Manmohan, who is facing trial before the learned lower Court, are that on 18.05.2014 deceased Laxmi Devi wife of the petitioner had died after a scuffle.

It is contended on behalf of the petitioner that he is in custody since 18.05.2014 and that the trial has not been completed and that the only witness so examined has not supported the prosecution which has been strongly opposed by the learned State counsel.

    Heard.

Record of the trial Court reflects that the prosecution till date has examined six witnesses and that the averment of learned counsel for the petitioner that they have turned hostile is certainly not born out of the same, as complainant Sughad Singh father5in5law of the petitioner as PW1 has never been declared so by the learned trial Court.

Keeping in view seriousness of the allegations and the fact that the widow has died an unnatural death in her matrimonial home within one year of the marriage leaves no scope to take the case of the petitioner for grant of regular bail sympathetically.
