*** JASWANT SINGH, J.(ORAL) Prayer on behalf of accused Satender @ Gola, Sandeep son of late Mahender and Sandeep son of Shiv Dhan is for grant of regular bail in case FIR No.275 dated 24.5.2015 under Sections 147,149,323,506 IPC (Sections 325,326,307 IPC added later on), Police Station Dadri Sadar, District Bhiwani. Since there are direct allegations against petitioner No.2 (Sandeep son of late Mahender) and petitioner No.3 (Sandeep son of Shiv Dhan) of having inflicted brick blows on the face, nose, mouth, head and chest of the injured Sunil, at the time of hearing, learned counsel for the petitioners prays for withdrawal of petition on their behalf. Therefore, the prayer

CRM-M No.6008 of 2016 #2# made is only in respect of petitioner No.1-Satender @ Gola. It is contended that identically situated co-accused Naveen @ Jangi and Pardeep @ Naad have since been granted regular bail. It is stated that the petitioner is in custody since 29.8.2015 and none of the witnesses has yet been examined. Learned state counsel, on instructions from ASI Satbir Singh, does not refute the aforesaid factual situation. Without commenting upon the merits of the case and keeping in view the parity of treatment and the fact that the trial is not likely to conclude in near future, no useful purpose would be served in keeping the petitioner in custody any longer. Accordingly, the present petition is allowed and petitioner No.1-Satender is ordered to be released on bail to the satisfaction of the Chief Judicial Magistrate/Duty Magistrate, Bhiwani.
