(Oral) Present petition has been filed under Section 528 BNSS, 2023 seeking issuance of directions to respondents No.2 to 4 to conduct fair investigation in the case FIR No.35 dated 02.06.2024 (Annexure P-1) under Sections 323, 341, 379-B, 148 and 149 IPC (Section 325 IPC added later on vide DDR No.20 dated 12.08.2024) registered at Police Station Sadar Ahmedgarh District Malerkotla as well as cross case DDR No.13 dated 06.10.2024 (Annexure P-3) under Sections 325, 323, 34 IPC registered at Police Station Sadar Ahmedgarh District Malerkotla. 2.

Learned counsel for the petitioner has contended that the FIR in the present case was registered on 02.06.2024 while the cross case was registered on 06.10.2024. The investigation is yet to be completed and the petitioner has the apprehension that the other party will get the DDR cancelled in the cross version case.

CRM-M-21449-2025 respondent-State and submits that the short reply by way of an affidavit of Rajan Sharma, DSP, Sub Division Ahmedgarh District Malerkotla on behalf of respondents No.1 to 4 is already on record.

While referring to para 14 of the reply, learned State counsel submits that SSP, Malerkotla in recognition of the significance of the case, initiated the formation of a Special Investigation Team through office order No.262-66/PC dated 25.03.2025 to conduct fair and impartial investigation of this case as well as cross case, which are pending investigation and on completion of the same, further necessary action will be taken as per law. 6.

Heard learned counsel for the parties and perused the relevant material available on record.

Keeping in view the reply filed by the learned State counsel, no further order is required to be passed in the present petition as the same has been rendered infructuous.

Accordingly, the present petition stands disposed of having been rendered infructuous.
