Rajan Gupta, J (Oral) Petitioner has filed this petition under Section 482 Cr.P.C seeking quashing of F.I.R No. 205 dated 14.9.2011 registered under Sections 498-A/323/406/506/34 IPC at Police Station, Adampur, District Jalandhar and all the subsequent proceedings arising therefrom on the basis of compromise.
Complainant/respondent No.2 is present in court. She is duly identified by her counsel.She has filed an affidavit in court today, which is taken on record as Mark 'A', wherein the factum of compromise arrived at between the parties has been admitted. She states that she has no objection if the present FIR is quashed.
Learned State counsel submits that since the parties have arrived at an amicable settlement, the State would not stand in the way of
CRM-M-7174 of 2015 2 quashing of the FIR on the basis of compromise. The compromise is in the interest of the parties and after the matter has been resolved by an amicable settlement, no useful purpose is is likely to be served by continuance of the criminal proceedings. In view of above, the present FIR and the consequent proceedings arising therefrom deserve to be quashed in light of Full Bench judgment of this court in Kulwinder Singh and others Vs. State of Punjab, 2007(3) RCR (Crl) 1052.
Resultantly, the present petition is allowed. The F.I.R in question and the subsequent proceedings arising therefrom are quashed. (Rajan Gupta) Judge April 20, 2015 BB
