Jaswant Singh,J.(Oral) Four accused petitioners namely Rajwinder Singh @ Latu, Gursewak Singh @ Sewak, Ashu @Ankush and Romy have filed the present petition under Section 482 Cr.PC seeking quashing of FIR No.199 dated 13.8.2011 under Sections 307, 325, 323, 148,149 IPC, PS City Kotkapura,Distt.Faridkot and all subsequent proceedings on the basis of compromise dated 25.1.2016(P-2).
As per prosecution case the said four accused petitioners alongwith six other non-applicants co-accused, armed with rods and dandas waylaid complainant Munish Puri and inflicted injuries upon RAJINDER PRASHAD JOSHI 2016.04.22 14:29 I attest to the accuracy and authenticity of this document High Court, Chandigarh.
CRM-M 6021/2016 him. Legs and arms of complainant are stated to have been broken. Vide order dated 31.3.2016 parties were directed to get their statements recorded before the trial court with regard to genuineness of the compromise,whereafter trial court was to send its report.
In compliance thereof, learned JMIC,Faridkot vide his report dated 11.4.2016 has reported that parties have acknowledge the compromise but the present four accused are stated to be involved in number of cases involving serious offences.
Learned State counsel on instructions also points out that there are five other co-accused one of them a PO qua whom the allegations still subsist and therefore,there cannot be any partial compromise.
At this stage,learned counsel for the petitioners prays for permission to withdraw the present petition.
Dismissed as withdrawn.
