(ORAL) Petitioner seeks pre-arrest bail in criminal complaint No. 51/3 dated 18.2.2013 under Sections 3 clause I, VIII & IX of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act, 1989, read with Section 506 IPC, titled as Karam Singh Vs. A.N. Chauhan, pending before the court of learned Additional Chief Judicial Magistrate, Yamuna Nagar at Jagadhri. Notice of motion was issued and arrest of the petitioner was stayed, vide order dated 3.3.2015. Thereafter, case was disposed of, vide order dated 20.7.2015. However, order dated 5.10.2015 passed by this Court would show that the order dated 20.7.2015 was recalled, it having been passed because of inadvertence as the complete facts were not brought to the notice of the Court. Criminal Misc. No. M-7206 of 2015 However, it is not denied before this Court that in compliance of the order dated 3.3.2015, petitioner has appeared before the learned trial court. There are numerous orders available on the case file passed by the learned trial court. Learned counsel for the complainant disputes the fact that petitioner has surrendered before the learned trial court in compliance of the order passed by this Court. Be that as it may, petitioner is directed to appear before the learned trial court on or before 30.10.2015 and learned trial court shall release the petitioner on bail pending trial on his furnishing adequate bail bonds/surety bonds to its satisfaction.
