(ORAL) Prayer in the instant petition under Section 438 Cr.P.C. has been made for grant of anticipatory bail to the petitioner in Criminal Appeal No. CRA-204-2017 dated 26.04.2017 pending before Addl. Sessions Judge, Gurugram, against the judgment of JMIC, Gurugram dated 29/30.03.2017, whereby, the petitioner was convicted in Complaint No.1356/16 dated 15.02.2016, in which, due to advertent non-appearance of the petitioner and his counsel, arrest warrants have been issued vide order dated 14.09.2018 (P-5) and 30.11.2018 (P-6). Heard.

The impugned order dated 14.09.2018 (P-5) cancelling the bail/surety bonds of the petitioner and forfeiting the same to the State is recalled, subject to his depositing half of the cheque/compensation amount in the name of appellate court, who, in turn, shall convert the SONIKA 2019.05.23 16:57 I attest to the accuracy and authenticity of this document Chandigarh

CRM-M-22892-2019 --2-- same into a STDR (fixed deposit receipt) in some nationalised bank, fetching maximum rate of interest to save loss of interest to the party, who shall finally be held entitled for the same by the appellate court, and keep the original STDR receipt with him.

In case, the petitioner deposits half of the cheque/compensation amount awarded to the respondent by the trial court, he shall be released on interim bail, on his furnishing fresh bail/surety bonds. This order shall not be an embargo to conduct proceedings against the petitioner, if any, independently under Section 446 Cr.P.C..
