Surinder Gupta, J. (Oral) Vide this common order, the above captioned appeals are being disposed of as these arise out of same award dated 16.08.2004 passed by Motor Accident Claims Tribunal, Patiala.

Learned counsel for the parties submit that the matter regarding payment of balance amount has been amicably settled by the parties. As per submission made on 27.08.2016, a sum of `1 lac has been paid by respondent -Nachhatar Singh @ Fauji to appellant-Amrik Singh. He will pay balance amount to the appellant in two equal installments. Both the appeals (FAO No. 3794 of 2007 and FAO No. 1120 of 2005) are disposed of in view of settlement arrived at between the parties on Jitender Kumar 2016.10.06 17:15 I attest to the accuracy and integrity of this document

As per settlement, Nachhatar Singh @ Fauji had agreed to pay `4 lacs to claimant-Amrik Singh in addition to `1 lac already paid by him. Out of `4 lacs, he had paid `1 lac to claimant-Amrik Singh. He will pay balance amount in two installments out of which first will be paid on or before 30.11.2016 and next installment by 31.05.2017. In the event of amount being not paid as per above schedule, Nachhatar Singh @ Fauji shall be liable to pay interest @ 7.5% per annum from the date of filing of the appeal till the date of payment on the amount due under the settlement. Copy of this order be placed on the file of other connected matter.
