(Oral) Accused-petitioner Sandeep Singh @ Sandeep Saini has filed this anticipatory bail application in case bearing FIR No. 216 dated 25.10.2018 under Sections 406, 498-A, 506 IPC, Police Station City Rupnagar.

Upon hearing counsel for the two sides and perusal of the records, it is duly admitted by the two sides that upon registration of the case, the petitioner was allowed anticipatory bail

-2by the court of learned Additional Sessions Judge, Rupnagar on 5.11.2018 and as a stipulation he was directed not to leave the country without prior permission of the Court. However, as is conceded to before this Court, petitioner left India on 27.12.2018 and arrived back on 15.1.2019. It is in between on the application of the complainant side, the court below vide impugned orders dated 24.4.2019 had recalled the bail orders and cancelled his bail bonds. That is how the present petition has come about. Appreciating the arguments and perusing the records it is not displaced by any of the sides that the petitioner had been regularly appearing before the court below and the only remiss that has come about on his part of having violated the terms and conditions of the grant of anticipatory bail under Section 438 Cr.P.C.

It would be traversity of justice to send the petitioner behind the bars and it would suffice the purpose to order in the interest of justice directing the petitioner to appear before the trial court within 15 days from today and surrender himself before the court. Upon doing so, he shall be released on bail subject to his deposit in the court his passport and all travelling documents and undertaking not to misuse the concession of bail subject to furnishing of two sureties of heavy amount to the satisfaction of the trial court.

-3petitioner shall be returned subject to the final outcome of the trial court verdict. The trial court shall be at liberty to proceed against the petitioner for this violation in any other way in accordance with law. The present petition stands disposed off accordingly.
