(Oral) Present petition has been filed seeking directions to respondent Nos. 2 to 5 to conduct fair and impartial investigation with regard to FIR No.73 dated 27.02.2023, under Sections 323, 342, 336, 506 read with Section 34 IPC and Section 307 IPC (added later on) and Sections 25/27/30/54-59 of the Arms Act, 1959, registered at Police Station, Model Town, District Hoshiarpur by constituting a Special Investigating Team (SIT) consisting of Senior Police Officials.

Learned State counsel, on instructions from Inspector Jatin Kapoor, submits that SIT has already been constituted which is headed by an Officer of the rank of ADGP, Punjab and investigation is going on. 3.
It appears that, merely on imagination of the petitioner some hypothesis is created that nephew of accused-Dr. Satwant Singh, namely Dr. Rajdeep, who is stated to be remotely related to the officer heading the SIT can influence the investigation. He is a practicing physician at Ludhiana. The biological parents of the minor child are also physicians but at Hoshiarpur. 2023:PHHC:104229 CRM-M-24596-2023 Adoption of the minor is under dispute between the parties and is the real genesis of FIR. Transfer of investigation is, therefore, sought. 4.
On a Court query, it transpires that said Dr. Rajdeep, a resident of Ludhiana, is a general physician and is from a different stream altogether as the biological parents are Radiologist and General Surgeon and are residents of Hoshiapur.

On a further query, it also transpires that they were never known to each other in the past as they were neither colleagues anywhere at any hospital nor even in the same medical college or having remained classmates during their MBBS course. It appears that present petition has been filed based on totally unfounded apprehension and same does not deserve any interference. In any case, the father of the child, namely, Dr. Satwant Singh, is currently abroad (Ohio, USA) for a one-year course in Radiology.

Consequently, I find no ground to interfere. Petition is dismissed. 7.
