(Oral) This is a petition filed for anticipatory bail under Section 482 of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 in case bearing FIR No.43 dated 02.03.2025 under Section 61 of the Excise Act, 1914, registered at Police Station Gharinda, Amritsar Rural, District Amritsar. The case of the prosecution is that recovery of 200 litres, a drum of 50 litres along with other utensils containing 50 litres of fermented lahan has been affected from the house of the petitioners. However, the petitioners were not present at the spot. It is stated that no independent witness as well as no neighbour was associated during the raid and only official witnesses conducted the raid.

This Court, vide order dated 01.05.2025, had directed the petitioners to appear before the Investigating Officer and join investigation and in the event of their arrest, they were ordered to be released on ad-interim bail to the satisfaction of the Investigating/Arresting Officer, subject to the Sonia Puri 2025.07.14 16:57 I attest to the accuracy and integrity of this document

Learned State counsel on instructions states that the petitioners have joined the investigation and are not required for custodial interrogation. 5.
In view of the submissions of learned counsel for the petitioners especially when the petitioners have cooperated with the investigating officer, the order dated 01.05.2025 granting interim bail to the petitioners is made absolute.

However, the petitioners shall abide by the conditions stipulated under Section 482, BNS. They shall also join investigation as and when called upon to do so.

The petition stands allowed.
