Through this petition, the petitioner seeks anticipatory bail in case bearing FIR No.192 dated 04.08.2020, registered at Police Station Dhariwal, District Gurdaspur, under Section 420 IPC. I have heard the learned counsel for the parties. A Coordinate Bench, on 18.08.2020, passed the following order:
"A perusal of the case file reveals that the alleged amount of Rs.60,000/- was given by the complainant in the year 2019 for sending his son abroad and later on the accused issued cheque in favour of the complainant to return the amount in installments. Notice of motion for 26.11.2020.
Meanwhile, the petitioner shall join the investigation and would come present as and when called for and in the event of arrest, the petitioner shall be admitted to interim bail on his furnishing personal and surety bonds to the satisfaction of Arresting/Investigating Officer. The petitioner shall also abide by the conditions as specified under Section 438 (2) Cr.P.C."

In view of the above, without commenting on the merits of the case, the present petition is allowed and the order dated 18.08.2020 granting interim bail to the petitioner, is made absolute, subject to the conditions laid down in Section 438 (2) of the Code of Criminal Procedure. 26.11.2020
