The petitioner is seeking the concession of anticipatory bail under Section 438 of the Cr.P.C. in case FIR No.47 dated 07.04.2024 under Section 420 of the Indian Penal Code, 1860, registered at Police Station Division No.5, District Ludhiana.

On 14.05.2024, while noticing the following submissions made by the learned counsel for the petitioner, a Coordinate Bench of this Court, had granted the concession of interim bail to the petitioner and asked her to join investigation:- "Learned counsel for the petitioner inter alia submits that the petitioner is interested in settling the dispute with respondent Nos.2 and 3/complainants and in order to show her bona fide, two post dated cheques Nos.140036 dated 30.05.2024 and 140038 dated 15.06.2024 total amounting to Rs.4,00,000/- have been produced in Court today." Learned counsel for the petitioner submits that in compliance of order dated 14.05.2024, the petitioner has joined investigation and cooperated with the investigating agency. It has also been stated that to show her bona fides two post dated cheques already stand given to the complainant which fact has not been disputed by the learned counsel for the complainant.

Learned State counsel, on instructions from ASI Mohan Lal, does not dispute the factum of the petitioner having joined investigation and cooperated with the investigating agency. He, on further instructions, submits that the petitioner is not required for further investigation much less for her custodial interrogation.

In view of the above, the petition is allowed and interim order dated 14.05.2024, is made absolute subject to the conditions laid down in Section 438(2) Cr.P.C.
