Prayer in this writ petition filed by the petitioner under Articles 226/227 of the Constitution of India, is for issuance of a writ in the nature of mandamus, directing the respondent - Corporation to open the 'sealed cover' (as the orders on the charge-sheets have passed) in case of the petitioner and thereafter, grant him deemed date of promotion w.e.f. 12.06.2021 to the post of Additional Assistant Engineer (AAE) from the post of Junior Engineer (JE) under the Reserved Category (SC), having Seniority No.10066, from the date, when his junior respondent No.5 (under reserved category) having Seniority No.10068, was granted promotion by the respondent - Corporation to the post of Additional Assistant Engineer (AAE). Further prayer has been made to issue direction to the respondent - Corporation to grant all the promotional consequential benefits to the petitioner along with interest @ 18% per annum w.e.f. 12.06.2021.

Learned counsel for the petitioner, at the very outset, confines his prayer for deciding legal notice dated 29.03.2024 (Annexure P-13). He submits that at this stage, petitioner would be satisfied, if the said legal notice is decided by passing a speaking order within a time bound frame.

Mr. R.S. Kalra, Advocate, accepts notice on behalf of the respondents and has no objection to the innocuous prayer made by learned counsel for the petitioner.

I have heard learned counsel for the parties and have gone through the record of the case.

Without going into the merits of the case at this stage, the present petition is disposed of with a direction to respondent No.1, to decide legal notice dated 29.03.2024 (Annexure P-13), expeditiously submitted by the petitioner by passing a speaking order, preferably within a period of 03 months from the date of receipt of certified copy of this order.
