M. M. S. BEDI, J. (ORAL) The petitioner, for having been found in possession of 01 kg of smack, has been in custody from 16.03.2015. On instructions from SI Ram Kumar, it has been informed by the State counsel that 07 out of 13 prosecution witnesses have already been examined.
Taking into consideration the quantity of smack recovered from the petitioner and status of the trial, I deem it appropriate to dispose of this petition with a direction that the
CRM NO. M-6170 OF 2016 (O&M) -2trial Court shall make earnest endeavour to conclude the trial within a period of four months by examining all the witnesses within a period of three months from the next date of hearing. In case the prosecution agency is not able to produce all the witnesses within a period of three months, the trial Court shall release the petitioner on bail on his furnishing bail bonds/surety bonds to its satisfaction after the expiry of four months from the next date of hearing.
