Petitioner - Simranjeet Singh, has filed the instant petition under Section 482 of the BNSS, 2023 (erstwhile Section 438 Cr.P.C.), seeking grant of anticipatory bail in case FIR No. 0013, dated 01.12.2024, registered under Section 318(4) of BNS, 2023, Section 66(D) of Information Technology Act, 2000 and [Section 336(3), 340 of BNS, 2023 added later on) (Corresponding Sections 420, 468, 470 of IPC), lodged at Police Station Cyber Crime, Jalandhar Rural, District Jalandhar. 2.

Complainant - Ram Dass moved a complaint that the FDR of Rs.4,00,000/- has been got broken by some unknown person/accused by making two transactions of Rs.2.00 lacs (each). 3.

It is further clarified that after lodging complaint at 1930 portal, an amount of Rs.1,84,000/- has been released on superdari by the Court. However, Rs.2,16,000/- still to be recovered. 4.

CRM-M-21046-2026 - 2 - and 358936974850623 and email Id: gauravchadha73@gmail.com was used, in mobile SIM No.93025-10001 and 18150-28940 in the name of one Karan Kumar, who is also co-accused of the petitioner. 5.

Learned State counsel, who appears on advance notice, on instructions from ASI Gagandeep Singh, informs that the IP address pertaining to the petitioner as well as his co-accused - Karan Kumar, in the present crime, is the same, which had also surfaced earlier in some other case.

So far as, the argument that not a single penny has been siphoned into the bank account of the petitioner rather the amount stands credited in the account of one Bhupesh Kumar, resident of Durg, Chhattisgarh, is concerned, the same requires consideration only after the petitioner joins investigation and is confronted by the Investigating Officer as to how, by using the IP address of this area, the amount in question came to be transferred into the account of another person belonging to the State of Chhattisgarh.

Thus, in view of the above, finding no merit in the instant petition, the same is dismissed.
