The instant petition has been filed on behalf of the petitioner seeking grant of anticipatory bail in respect of aforementioned FIR. 2.
The FIR was lodged on the basis of secret information received by the police to the effect that Shamshar Ali @ Shali, who sells milk, indulges in sale of stolen motorcycles. The information was further to the effect that even on the given day, he was having a stolen 'pulsar' motorcycle and was waiting for customers at 'Saini Trala Center'. Pursuant to receipt of secret information, a raid was conducted and Shamshar Ali @ Shali was apprehended at the spot, who disclosed that he had purchased the motorcycle from Sandeep Kumar for an amount of Rs.10,000/-. CRM-M-24258-2024 (O&M) ( 2 ) his interrogation, he disclosed that Sukhwinder Singh @ Sukha and Balraj Singh @ Kala had handed over the said motorcycle to him. 3.
Learned State counsel, upon instructions from the Investigating Officer, has informed that pursuant to interim directions, the petitioner has since joined investigation and is not stated to be wanted in any other case. 4.
Having regard to the fact that the petitioner was nominated on the basis of disclosure statement and has otherwise joined investigation and has clean antecedents, his custodial interrogation is not warranted. The instant petition, as such, is accepted and the interim directions issued by this Court vide order dated 15.5.2024 are hereby made absolute, subject to the condition that the petitioner shall join investigation as and when called upon to do so and cooperate with the Investigating Officer and shall also abide by the conditions as provided under Section 438(2) Cr.P.C.
