Prayer in this petition is for grant of regular bail to the petitioner, in a case arising out of FIR No. 125 dated 05.08.2015, registered at Police Station Radaur, District Yamuna Nagar, who has been booked for having committed the offence punishable under Sections 498A/406/376/377/313/34 IPC. On 24.02.2016, learned State counsel has informed the Court that only charges have been framed and statement of the complainant has not been recorded so far. Today, learned State counsel on instructions from ASI Suresh Pal has informed the Court that statement of the prosecutrix/complainant has been recorded and her cross examination has been deferred as application under Section 319 Cr.P.C for summoning accused has been filed and the trial is now fixed for 28.07.2016 for GAURAV ARORA 2016.07.25 15:40 I attest to the accuracy and integrity of this document

Petitioner is in custody since 13.10.2015 I have heard the learned counsel for the parties and with their able assistance gone through the material available on record. Keeping in view the period of incarceration of the petitioner and the fact that evidence of the complainant has been recorded, this court feels that there is no need to detain the petitioner any longer. Accordingly, the present petition is allowed.
