Prayer in this writ petition filed by the petitioners under Articles 226/227 of the Constitution of India, is for issuance of a writ in the nature of mandamus, directing the respondents to grant the benefit of leave encashment for 450 days to the petitioners in lieu of unutilized earned leave lying at their credit on the dates of their superannuation rather than payments of 300 earned leave (paid to the petitioner) along with arrears of pay and consequential benefits with interest @ 12% per annum.

Learned counsel for the petitioners, at the very outset, confines his prayer for deciding legal notice dated 10.01.2024 (Annexure P-4). He submits that at this stage, petitioners would be satisfied, if the said legal notice is decided by passing a speaking order within a time bound frame.

Mr. Rajesh Sehgal, Addl. A.G., Punjab, accepts notice on behalf of respondents No.1, 2, 4 and 7 and has no objection to the innocuous prayer made by learned counsel for the petitioners. 5.

I have heard learned counsel for the parties and have gone through the record of the case.

Without going into the merits of the case at this stage, the present petition is disposed of with a direction to respondent No.2 to decide legal notice dated 10.01.2024 (Annexure P-4), expeditiously submitted by the petitioners by passing a speaking order, preferably within a period of 03 months from the date of receipt of certified copy of this order.
