The present matter is an appeal challenging the order of acquittal dated 05.06.2018 passed by the Ld. Additional Sessions Judge, Amritsar, whereby the accused/respondent No.2 herein, namely, Sukhdev Singh was acquitted from the offence punishable under Section 307 of IPC and Section 27 of the Arms Act. 2.

Learned counsel appearing on behalf of the appellants pleads no instructions. It appears that the appellants/complainant(s)/victim(s) are not interested to pursue the present appeal.

Given above, the present Leave to Appeal is dismissed for nonprosecution with liberty to file a fresh one. It is clarified that that Registry of this Court shall not entertain any application for restoration of the present matter. However, time for which the present Leave to Appeal was pending before this Court shall not be counted for the purpose of limitation, as the limitation would start from tomorrow.
