The petitioner is aggrieved by order dated 01.04.2019 passed by the Additional District Judge, Patiala whereby an appeal in the case relating to Payment of Wages Act,1936, delay of 196 days in filing the appeal was condoned.
It was claimed in the application that applicant is an illiterate agricultural driver and he didn't know that his case has been dismissed. After considering the facts and circumstances and taking a liberal view of the matter, as laid down in several authoritative pronouncements of superior court, delay has been condoned.

CR No.3247 of 2019 [2] I am of the view that once it is found that petitioner is an illiterate labour and the case is under Payment of Wages Act, the Trial Court was justified in condoning the delay of 196 days in filing the appeal. No ground to interfere in the impugned order is made out. Dismissed.
