**** ANITA CHAUDHRY, J The petitioner is seeking regular bail in FIR No. 834 dated 18.8.2018 registered at Police Station Chandnibagh, District Panipat under Sections 342, 354, 376, 506, 34 IPC and Section 3 of Scheduled Caste and Scheduled Tribes (Prevention of Atrocities) Act, 1989. Counsel for the petitioner contends that the FIR has been lodged after a delay of four days and there are no allegations of rape against the petitioner and the victim has been changing her statement and challan has already been presented and the main accused is Dilip against whom allegations of rape had been made. The counsel further submits that the prosecutrix is major.
Investigation is over. The allegations of rape are against Dilip. There are no allegations of rape against the petitioner. The prosecutrix is said to have gone with the petitioner on his motor cycle. Crl. Misc. No. M-48457 of 2018 -2that the petitioner had flirted with her and had molested her. The trial would take time. Without commenting anything on the merits of the case, the petition is allowed and the petitioner is ordered to be released on bail on his furnishing bail/surety bonds to the satisfaction of the trial Court/Duty Magistrate.
