This is a petition under Section 438 of the Code of Criminal Procedure, 1973 for grant of anticipatory bail to the petitioner in FIR No.259 dated 01.04.2023 under Sections 406/498-A/506/323/377/511/379-A/120-B of the Indian Penal Code, 1860 (IPC) (Section 420 IPC subsequently added) registered at Police Station Sector 8, District Faridabad. 2.

On 24.05.2023 the following order was passed :

CRM-M No.24937 of 2023 - 2 - "It is not disputed at Bar that some of the alleged articles of dowry have been handed over to the Investigating Officer, as per statement made before this Court on the last date.

Learned counsel for the petitioner as well as complainant are ad idem that disputes between the parties can be settled by way of mediation, and for that purpose, the parties may be referred to Mediation & Conciliation Centre of this Court.

Learned counsel for the petitioner contends that petitioner shall come to India and join the mediation. The parties are, accordingly, directed to appear before the Mediator on 01.06.2023.

Adjourned to 17.07.2023.

The Mediator shall submit his/her report before the adjourned date.

In the meanwhile, the petitioner's arrest shall remain stayed to facilitate the mediation."

Thereafter, vide order dated 17.07.2023 the petitioner was directed to join investigation. Learned counsel for the State on instructions from SI-Anand Pal has stated that the petitioner has since joined the investigation. Learned counsel for the petitioner as well as learned counsel for the complainant are ad idem that the matter now stands amicably settled between the parties and a petition under Section 13-B of the Hindu Marriage Act, 1955 has been filed and an amount of Rs.25 lakhs has also been paid.

Learned counsel for the complainant states that in view of the above he would have no objection if the order dated 17.07.2023 is made absolute.

In view of the above, the order dated 17.07.2023 is made absolute. The petitioner shall, however, join investigation as and when called. The petitioner shall also abide by all the terms and conditions as specified under Section 438(2) of the Code of Criminal Procedure, 1973. 6.

Disposed off accordingly. Pending applications, if any, also stand disposed off.
