CRM-M-7428 of 2015 Petitioner seeks transfer of the investigation of FIR No. 48 dated 1.6.2012 under Sections 302/120-B/34 IPC registered at Police Station Garhshankar, District Hoshiarpur to CBI or any other independent agency.

Crl. Misc.M-7428 of 2015 constitution of a Special Investigation Team vide order dated 5.5.2014 (Annexure P-4) in compliance of order Annexure P-1, report under Section 173 Cr.P.C. has not been presented to the learned court of competent jurisdiction so far. No reason for this inordinate delay was disclosed in the reply dated 18.2.2015 to the RTI application submitted by the petitioner.

Having heard the learned counsel for the petitioner and after careful perusal of the record of the case, present petition is disposed of with direction to respondent No.3 to look into the matter and ensure that SIT constituted vide order dated 5.5.2014 (Annexure P-4,) submits the final report under Section 173 Cr.P.C., at an early date, after taking the investigation to its logical end. With the abovesaid observations made and directions issued, present petition stands disposed of.
