SANDHAWALIA, J.(Oral) The present appeal is directed against the interim order dated 20.12.2021 passed in CM No.16917 of 2021 in CWP No.6863 of 2021 titled as Amateur Kabaddi Association Haryana Versus Amateur Kabaddi Federation of India and others, whereby the learned Single Judge, while disposing of the application for vacation of stay, ordered to hear the main case on the date fixed, i.e 21.01.2022.

Vide order dated 31.05.2023, notice in the application for seeking condonation of delay in filing the instant appeal was issued for 05.07.2023, pursuant to which Ms. Nidhi Sharma, Advocate, had appeared on behalf of respondent No.1 and filed her Memo of Appearance in the Court and the case was adjourned to 12.07.2023. Today, none has put in appearance on behalf of the parties. 4.

We have been informed that the afore-said writ petition has been allowed by the learned Single Judge vide order dated 17.08.2023 and the orders dated 15.02.2021, referring the dispute to arbitration and dated 19.02.2021, nominating the sole arbitrator, passed by the Administrator have been set-aside and respondent No.2, if so advised, has been granted liberty to take recourse to the remedy of appeal. Thus, we are of the considered opinion that the present appeal has been rendered infructuous and the same is disposed of as such.
