(Oral) The petition has been filed, inter alia, seeking a writ of mandamus directing the respondents to grant approval to the petitioner's appointment on the post of Clerk on regular basis in the respondent aided College. 2.

During pendency of the petition, the College issued an administrative order, dated 05.09.2024, to the following effect: In compliance of DGHE, Haryana letter no.18/20-2019 CII(5) dated 17.07.2023 and letter no.2/76-2022 C-II(4)/C-IV(2) dated 23.08.2024, you are hereby issued appointment orders for the post of Clerk w.e.f. 08.04.2003 on aided post (with retrospective effect) till the date of your superannuation on 31.12.2021 on attaining age of 60 years, in light of terms and conditions of the policy of the department bearing letter no.18/11969 CII(4) dated 02.08.1993. Learned counsel for respondents no.3 & 4/College contends that the Directorate ,vide memo dated 17.09.2024, asked the College to issue pay re-fixation order of the petitioner and send the calculation sheet with regard to arrears of pay at the earliest. Pursuant thereto, the petitioner's pay fixation order was issued by the College on 01.10.2024, and calculation sheet for the period 08.04.2003 to 31.12.2021 was also sent to respondent no.2 vide letter dated 19.09.2024, for further necessary action.

In view thereof, learned counsel for the petitioner contends that the petitioner's claim stands granted and the petition may be disposed of with a direction to respondent no.2/Director Higher Education to approve the refixation of pay and release the due amount of arrears on that basis within a period of three months.
