This is a petition filed under Section 438 Cr.P.C. seeking pre-arrest bail in a case registered against the petitioner vide FIR No. 59 dated 18.04.2012 under Sections 22/61/85 of the NDPS Act at Police Station Lahori Gate, Patiala.
Learned counsel for the petitioner submits that petitioner could not appear before the trial court on one date as he had noted a wrong date of hearing. Due to this reason, his bail bonds were cancelled and surety bonds were forfeited. Resultantly, non-baliable warrants of arrest were issued. According to learned counsel, petitioner had been regularly appearing before the trial court and never intended to absent from the court proceedings. He submits that petitioner is ready to furnish an undertaking that he shall not absent himself from court proceedings on any date in future.

In view of above, this petition is allowed and it is directed that in case petitioner surrenders before the trial court within a week from today, he shall be admitted to bail. This, however, will be subject to undertaking aforesaid and any other condition(s) deemed fit to be imposed by the court below.
