Notice of motion.
On asking of the Court, Mr. L.C. Aggarwal, AAG, Punjab, who is present in the Court accepts notice and submits that intimation by Registry informing of fixation of the petition has already been received and record of the case is available with him.
Learned counsel for the petitioner submits that Gurnam Singh co-accused similarly placed has been allowed bail vide order dated 24.08.2015 passed in CRM-M-17133 of 2015. The evidence and role of petitioner-Satwinder Singh in the crime as alleged by the prosecution, is also similar. CRM-M-631-2016 -2Jagalip Singh submits that Gurnam Singh was allowed bail as the prosecution failed to conclude the evidence on 24.12.2015. Now, the case is adjourned to 11.02.2016, for evidence of the prosecution.
Applying the principle of parity, the instant bail application is allowed. Petitioner Satwinder Singh be released on bail on furnishing bail bond and surety bond in the sum of `1 lac to the satisfaction of trial Court/Chief Judicial Magistrate, Ludhiana subject to following terms:- a. The petitioner-accused shall comply with the conditions mentioned in Section 437(3) Cr.P.C. b. In the event of his absence on any date of hearing, the benefit of bail allowed to the petitioner shall stand withdrawn. The trial Court shall be competent to cancel his bail bond and surety bond and proceed to procure his presence in accordance with law. In that eventuality the petitioner-accused shall have to apply for bail afresh before the trial Court.
c. He shall not leave the country without the previous permission of the Court.
