Petitioners have filed this petition under Section 407 against respondent Pinki Anand for transfer of complaint under Section 500 IPC, Police Station, Civil Lines, Hisar titled as 'Pinki Anand vs. Surinder Kaur and others, pending in the Court of learned Judicial Magistrate Ist Class, Hisar, to any other Court of competent jurisdiction at Panipat. At the time of arguments, learned counsel for the petitioner only argued on one point i.e. regarding the inconvenience of one of the petitioner to visit the Court at Hisar. No other ground has been argued except the inconvenience to the petitioners to attend the Court proceedings at Hisar.

After hearing learned counsel for the petitioners and after going through the record, I find that inconvenience of the accused is no ground to Vineet Gulati 2017.12.20 14:48 I attest to the accuracy and authenticity of this document Chandigarh transfer the criminal case from one place to another. It is settled law that

CRM No.M-47632 of 2017 -2criminal case should not be transferred in a routine manner. It is also settled law that in the criminal proceedings, the inconvenience to the accused is not to be seen. If the case is transferred from Hisar to Panipat, then it will cause inconvenience to the complainant as well as the witnesses. Therefore, finding no merit in the present petition, the same is dismissed.
