Earlier, the petitioner had filed anticipatory bail i.e. CRM-M-45898-2024, which was heard at length by a coordinate Bench and since the Court was not inclined, the same was dismissed as withdrawn, however, concession was granted that in case the petitioner surrenders before the trial Court within 2 weeks and applies for regular bail, the trial Court shall try to dispose of the said petition within a week. Thereafter, instead of surrendering, he filed another bail petition i.e. CRM-M-3451-2025 before this Court, which was dismissed for non-prosecution by the coordinate Bench. 2.

Now, the petitioner has again come up before this Court by filing 3rd bail petition under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023, [BNSS], seeking anticipatory bail in the FIR captioned above. 3.

This Court cannot act as an appellate Court over the coordinate Bench, which has already heard and dismissed for bail petitions twice vide orders dated 30.09.2024 and 22.01.2025. The order dated 30.09.2024 passed in CRM-M-45898-2024 reads as under:- "Reply by way of affidavit of Ms. Heena Gupta, PPS, Deputy Superintendent of Police, Sub-Division (Rural) District Bhatina has been filed by learned State counsel, which is taken on record. After arguing at length and upon finding that this Court was not agreeing with the contentions raised on behalf of the petitioner, learned counsel for the ASHWANI KUMAR 2025.05.21 16:12 I attest to the accuracy and integrity of this order/judgment Punjab & Haryana High Court, Chandigarh
