(ORAL) Prayer in the instant petition under Section 438 Cr.P.C. has been made for grant of anticipatory bail to the petitioner, in case, FIR No.456 dated 26.08.2017, registered under Sections 148, 149, 332, 353, 186, 506 IPC and Section 25 of the Arms Act as well as Section 120-B IPC (added lateron), Police Station Kotwali, District Faridabad. According to the prosecution, on 26.08.2017, five police personnel had taken the son of the petitioner namely, Rabbo to Escort Hospital, Faridabad, for medical treatment for his gun shot injury. On the same very night, the petitioner along with his companions got escaped his son from police custody, who was facing trial in FIR No.531 dated 20.08.2017, registered under Sections 148, 149, 307, 379-B IPC and under Section 25 of the Arms Act at Police Station SONIKA 2018.11.26 15:03 I attest to the accuracy and authenticity of this document Chandigarh

Learned counsel for the petitioner contends that in the CCTV footage of the Escort Hospital, Faridabad, photo of the petitioner is not there. The petitioner has falsely been implicated in the instant case, simply on the ground that he is father of Rabbo. No recovery has to be effected from the petitioner.

Considering the nature and seriousness of offence committed by the petitioner along with his companions of escaping his son from the police custody, this Court is not inclined to grant anticipatory bail to the petitioner.

Dismissed.
