The present petition has been filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short-'BNSS') for quashing of FIR No.109 dated 31.08.2023 under Sections 379,323,324,427,148,149,325,326 (added later on) of IPC registered at Police Station Dera Baba Nanak, Police District Batala and all the subsequent proceedings arising therefrom, on the basis of compromise dated 18.04.2025 (Annexure P-2).

Mr. Amandeep Singh Samra, AAG, Punjab accepts notice on behalf of the respondent-State. Learned State counsel states that no other FIR has been registered against the petitioners and they have no known criminal antecedents.

Ms. Gunkirat Kaur, Advocate appears and filed her Vakalatnama on behalf of respondent No.2 in the Court today and the same is taken on record. She confirms the factum of the compromise having been effected between the parties and states that respondent No. 2 has no objection to the quashing of the FIR in question.

In that view of the matter, even if this case is taken to its logical conclusion, it would only be an exercise in futility as the parties have already settled their differences. Therefore, no purpose would be served in wasting the time and resources of the State in pursuing this case to its pre-ordained end. It would, therefore, be better to give a quietus to the issue at this stage. 6.

Accordingly, the petition is allowed and FIR No.109 dated 31.08.2023 under Sections 379,323,324,427,148,149,325,326 (added later on) of IPC registered at Police Station Dera Baba Nanak, Police District Batala and all the subsequent proceedings arising therefrom, on the basis of compromise dated 18.04.2025 (Annexure P-2) shall stand quashed qua the petitioners. 7.
