Present petition has been filed under Section 528 of BNSS for issuance of direction to respondents no.1 to 3 to provide protection to life and liberty of the petitioners and to ensure the freedom to the petitioners, as the petitioners apprehend danger to their life and liberty at the hands of respondents no.4 to 7 and further to restrain the respondents from interfering in his life and property.

Learned counsel for the petitioners contends that the petitioners are the owners in cultivating possession of agricultural land measuring 56 kanals 12 marlas, purchased through a registered sale deed, and has sown wheat crop; that the revenue entry wrongly reflecting private respondents as possessors was corrected vide order dated 16.04.2024 passed by the Tehsildar, which has attained finality; that despite this, private respondents attempted to forcibly dispossess the petitioners from the said land, and

-2extended threats leading the petitioner to file a civil suit, wherein interim injunction dated 27.03.2026 was granted in favour of the petitioners restraining respondents from interfering in their possession, however, the local police, under influence of private respondents, is harassing the petitioners, threatening with false implication, and interfering in the civil dispute, compelling the petitioners to compromise the matter with private respondents and withdraw the civil suit. Learned counsel for the petitioners apprised the Court that representation dated 13.04.2026 (Annexure P-3) regarding threat to the life, property and liberty of the petitioners and their family has been moved through e-mail to respondents no.2 and 3 but no action has been taken so far.

The petitioners have approached this Court seeking protection in view of the fact that a civil litigation is pending between the parties and injunction order is also granted in their favour, but despite injunction, the respondents are trying to dispossess them and interfering with their possession. However, there are specific provisions to take action against contempt of the order of the Civil Court. Hence, in considered opinion of this Court, the issues raised in the present petition are directly and substantially in issue before the Civil Court, which is fully competent to adjudicate the same and grant appropriate relief, and interference by this Court is not warranted.

Regarding apprehension of threat to life and liberty, respondent no.3 / Senior Superintendent of Police, Sri Muktsar Sahib is directed to consider the representation dated 13.04.2026 (Annexure P-3) submitted by

-3the petitioners, conduct threat perception assessment, and thereupon take appropriate action in accordance with law.
