Mr.Yashwinder Singh,DAG Haryana assisted by ASI Om Parkash Jaswant Singh,J(Oral) Prayer is for grant of anticipatory bail to accused-petitioner Dharmender Sharma in case FIR No.473 dated 25.9.2015 under Sections 418 and 420 IPC, PS Kotwali,Distt.Faridabad.

As per allegations main accused Jagdish Bhatt and Anmol Bhatt are alleged to have purchased 300 tons of tin sheets from Sanjeev Aggarwal-complainant and did not pay the entire amount due. Petitioner is one of the purchasers from aforesaid main accused and has been implicated only with the allegation that the goods were sold by the accused at cheaper rates to various other shopkeepers.

It is contended that even on the face value, no offence against petitioner is made out apart from the dispute being of civil nature. Vide order dated 28.3.2016, petitioner was directed to join investigation and interim bail was granted.

CRM-M 6406/2016 submits that petitioner has joined investigation and fully cooperated. The learned State counsel on instructions submits that petitioner has joined investigation and his custodial interrogation is no longer required.

In view of the interim bail granted vide order dated 28.3.2016 is made absolute.
