*** ANIL KSHETARPAL, J (Oral) This is an application filed by the wife seeking transfer of the proceedings in HMA No.896 of 2021 (Varinder Singh vs. Priya) filed under Section 12 of the Hindu Marriage Act, 1955, pending before the District and Sessions Judge, Family Court, Ludhiana, to the Court of competent jurisdiction at Pathankot.

It has been asserted that the respondent is already defending two litigations at Pathankot Court. The first is a complaint under Section 498-A IPC whereas the second is a proceeding under Section 125 Cr.P.C. The distance between Pathankot and Ludhiana is stated to be 170 kms. It is further asserted that the petitioner is unemployed and has no source of income.

Keeping in view the aforesaid facts, the petition is allowed. The proceedings of HMA No.896 of 2021 (Varinder Singh vs. Priya) filed under Section 12 of the Hindu Marriage Act, 1955, pending before the District and ASHOK KUMAR 2021.09.14 10:34 I attest to the accuracy and integrity of this document

TA-623-2021 (O&M) Sessions Judge, Family Court, Ludhiana, are ordered to be transferred to the Court of competent jurisdiction at Pathankot. The transferor Court is requested to remit the case file to the transferee Court forthwith. The parties are directed to appear before the District Judge, Pathankot, on 30.09.2021 who will either decide the matter himself or assign it to the Court of competent jurisdiction at Pathankot.

All the pending miscellaneous applications, if any, are also disposed of.
