ANIL KSHETARPAL, J(Oral) In a suit for partition of the immovable property, a final decree for partition has been passed. In execution thereof, warrants of possession have been issued while dismissing the petitioner's objection petition. This revision petition has been filed challenging the order dismissing the second objection petition. The Court has noticed that previously also the petitioner filed objection petition which was dismissed on 08.01.2020.
The learned counsel representing the petitioner contends that house of the petitioner is located in Khasra No.642/2 and if the decree is permitted to be executed as such, he will suffer irreparable loss and injury. The Executing Court has to implement the decree as it is. The suit for partition remained pending for sufficient time as the same was filed in the year 2015. Further, once the previous objection petition has been dismissed, the scope of the Court becomes very limited.
Keeping in view the aforesaid facts, no ground to interfere is made out.
Dismissed.
All the pending miscellaneous applications, if any, are also disposed of.
