CORAM:

HON'BLE MR. JUSTICE INDERJIT SINGH

Present:

Mr.Rajinder Singh Aulakh, Advocate for the petitioner.

Mr.Sidamkeet Singh Sandhu, AAG, Punjab for the respondent-State.

**** INDERJIT SINGH, J.

Petitioner has filed this petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.216 dated 23.11.2018 under Sections 307, 34 IPC and Sections 25 and 27 of the Arms Act, registered at Police Station Nihal Singh Wala, District Moga.

Notice of motion was issued. Learned State counsel appeared and contested the petition.

I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. The perusal of the record shows that the petitioner is the main accused. There are four injured in this case. The petitioner had fired 4-5 shots from his fire arm weapon and caused injuries. CRM No.M-22642 of 2019 -2attributed to the petitioner.

Keeping in view the facts and circumstances of the present case, nature and gravity of the offence and in view of the fact that there is every chance that he may tamper with the evidence, I do not find it a fit case where petitioner is entitled to benefit of regular bail. Therefore, finding no merit in the present petition, the same is dismissed.
