(Oral) The allegations against petitioner Raju Bhullar @ Rajwinder Singh in this regular bail application under section 439 Cr.P.C. are that the petitioner along with his co-accused non-applicants has assaulted victims Vijay Kumar and Jagat Singh. The allegations against the petitioner are that he was armed with rod and gave blows on forehead and below knee of right leg of the victim. The contention of counsel for the petitioner that none of the injuries attributed to the petitioner is covered under section 307 IPC could not be controverted on behalf of the State. There is no medical evidence to support that these injuries were dangerous to life.

The very applicability of section 307 IPC being debatable issue and the fact that the petitioner is in custody since 19.6.2015 and the trial is not likely to be concluded in near future, without adverting to the merits of the case, this Dalbir Singh Tiwana 2016.08.03 10:45 I attest to the accuracy and authenticity of this document Punjab and Haryana High Court, Chandigarh.

Criminal Misc. No. M-6449 of 2016 -2Court is of the opinion that further detention of the petitioner in the present case is not warranted. Accordingly, he is ordered to be released on regular bail to the satisfaction of learned Chief Judicial Magistrate/Duty Magistrate, Faridkot.
