R.P. Nagrath, J. (Oral) Petitioner seeks bail under Section 439 Cr.P.C. in FIR No. 65 dated 23.06.2014 for offences under Sections 419, 420, 465, 467, 468, 471 and 120-B of Indian Penal Code (IPC), registered at Police Station City Fazilka, District Fazilka.

As per prosecution story, the allegations were made against four persons including the petitioner that they cheated the complainant party to part with an amount of ` 7 lacs on the pretext of selling property which was not belonging to the accused persons. The specific allegation of receipt of money was made against Ishwar Kumar and Dr. Rahul Khurana co-accused. There was no such specific allegation against the petitioner.

It is submitted that after framing of the charge two witnesses have so far been examined. Jaswant Singh co-accused in CRM-M-26397 of 2014 was granted pre-arrest bail by this Court on 14.08.2014, which was subsequently made absolute on 04.09.2014. CRM-M-7605 of 2015 -2The petitioner is in custody since 18.07.2014 and it will take a long time in conclusion of the trial. The offences are triable by the Magistrate.

In view of the above and without commenting on the merits of the case, the instant petition is allowed and the petitioner be admitted to bail on furnishing bail bonds to the satisfaction of the trial Court.

Allowed in the above terms.
